Terms of service

These Terms and Conditions ("Terms") apply to the purchase of whole, half, or quarter beef ("Beef") from Comanche Flats "Seller"). By placing an order and submitting payment, the customer ("Buyer") acknowledges and agrees to the following:

1. Nature of Purchase

Buyer understands and acknowledges that this purchase is for a future beef share, not an immediate delivery of packaged meat. The Beef is being purchased prior to harvest and processing.

2. Delivery Timeframe

Buyer acknowledges and agrees that:

  • The Beef will be delivered within an estimated 6–9 months from the date of purchase.

  • This timeframe is an estimate only and may be affected by factors including, but not limited to, animal growth, health, weather conditions, processing facility availability, and other agricultural or logistical factors.

  • Seller makes no guarantee of a specific delivery date.

3. Processing and Yield and Inspection Status

  • Buyer understands that this purchase is for a share of a live animal prior to slaughter.

  • Buyer acknowledges and agrees that the Beef is not being sold as USDA-inspected meat and is instead sold under applicable state and federal exemptions for the sale of shares of live animals.

  • The Beef is intended for personal consumption only by the Buyer and may not be resold.

  • Buyer understands that final take-home weight will vary based on the animal, processing method, and selected cut instructions.

  • All weights are estimates, and Seller does not guarantee a specific yield.

  • Processing and cutting is performed by a third-party processor, which may or may not be USDA-inspected, depending on availability and Seller arrangements.

4. Pricing and Payment

  • Purchase price is for the Beef share itself unless otherwise specified.

  • Processing, cut-and-wrap, and any additional fees charged by the processor may be paid directly by Buyer to the processor, unless Seller states otherwise in writing.

  • All deposits and payments are non-refundable once the order is placed, except at Seller’s sole discretion.

5. Substitution or Cancellation

  • In the event Seller is unable to fulfill the order due to unforeseen circumstances (including but not limited to animal illness, loss, or processor failure), Seller reserves the right to:

    • Substitute a comparable Beef share, or

    • Issue a refund or credit, at Seller’s discretion.

6. Storage and Pickup

  • Buyer is responsible for pickup or delivery arrangements once notified that the Beef is ready.

  • Buyer must have adequate freezer space prior to delivery.

  • Failure to pick up Beef within the processor’s required timeframe may result in storage fees or forfeiture, which shall be the Buyer’s responsibility.

7. No Resale

Buyer agrees that the Beef is purchased for personal use and not for resale unless permitted by applicable laws and regulations.

8. Assumption of Risk

Buyer understands and accepts the inherent risks associated with agricultural products and livestock production and agrees that variations in size, taste, and appearance are normal.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which the Seller operates.

10. Acknowledgment

By placing an order and submitting payment, Buyer confirms that they have read, understand, and agree to these Terms and Conditions, including acknowledgment that they are purchasing Beef now for delivery approximately 6–9 months in the future.
